Crane Accident Lawyer Near Sturgis
Evaluate Every Path to Compensation After a Crane Accident
Crane accidents can raise more than one path to compensation, particularly when a contractor, equipment manufacturer, or another company may share responsibility. At Beardsley, Jensen & Lee, we evaluate workers’ compensation and potential third-party claims together for injured construction workers in Sturgis and the Black Hills.
We examine incident reports, photographs, witness accounts, equipment information, and worksite records to determine how the accident occurred. Since 1997, we’ve represented clients in serious injury and wrongful death cases connected to industrial incidents.

Reporting a Crane Injury in South Dakota
Timely written notice helps establish when and how a work injury was reported. We advise workers to notify their employer in writing within three business days. Under South Dakota law, delayed notice can generally bar compensation unless the employer had actual knowledge of the injury or the worker had good cause for the delay.
The notice period doesn’t necessarily begin before a worker reasonably recognizes that an injury is serious. In McNeil v. Superior Siding, Inc., the court addressed the principle that the period begins when a reasonable person would recognize the nature, seriousness, and probable compensable character of the injury. Because notice disputes depend on specific facts, workers who didn’t immediately understand the extent of an injury should seek legal guidance promptly.
Important steps after a work-related crane accident include:
- Provide written notice: Identify the accident, injury, and date in a written notice to the employer within three business days when possible.
- Preserve available information: Keep copies of the notice, medical documents, photographs, and communications about the incident.
- Document changing symptoms: Record when symptoms began, how they developed, and when their seriousness became apparent.
What Happens After Injury Notice
After receiving notice, the employer should file the claim with its insurance company. The insurer generally has 20 days to investigate and decide the claim, although a 30-day extension may be available. These timeframes can depend on the circumstances and aren’t a substitute for advice about a particular claim.
The Division of Labor and Management within the South Dakota Department of Labor and Regulation administers workers’ compensation claims and disputes. We can review insurer communications, identify disputed issues, and explain the next procedural step.
