South Dakota Workers’ Compensation Basics for Oilfield Injuries

South Dakota workers’ compensation is administered by the Department of Labor and Regulation. For most workplace injuries, it is the exclusive remedy against an employer, meaning you can’t also sue your employer in civil court unless the injury resulted from an intentional tort. One important exception: South Dakota doesn’t require every employer to carry workers’ compensation insurance. If your employer is uninsured, you may be able to pursue them directly in civil litigation rather than through the compensation system.

Timing matters from the first day after an accident. Injured workers must give written notice of the injury to their employer no later than three business days after it occurs, or compensation may be denied without a reasonable excuse. As of July 1, 2025, weekly benefits are calculated at two-thirds of the injured worker’s average weekly wage, subject to a minimum of $554 and a maximum of $1,108 per week under the current rate schedule. Average weekly wage calculations can significantly affect total benefit amounts, and we work to ensure those figures are accurate.
